LIABILITY RELEASE AND WAIVER AGREEMENT 

HYDRAWAV3 LLC 

I, the undersigned, hereby acknowledge and agree to the following terms and conditions as a prerequisite for participating in wellness sessions provided by HydraWav3 LLC (hereinafter "HydraWav3"), a limited liability company with its principal place of business at 1846 E. Innovation Park Dr. Ste 100, Oro Valley, AZ 85755. 

 

1. Assumption of Risk 

I understand that HydraWav3 services involve therapeutic, non-medical wellness treatments that have not been evaluated, endorsed, or approved by the U.S. Food and Drug Administration (FDA) or any other regulatory agency for the treatment of medical conditions. I acknowledge that these services are intended solely for relaxation, stress reduction, and general well-being and are not a substitute for medical diagnosis or treatment. 

I acknowledge that participation in HydraWav3 sessions involves inherent risks, including but not limited to: 

Physical injury, bruising, swelling, burns, nerve damage, dizziness, or skin discoloration. 

Adverse reactions, including but not limited to allergic responses, sensitivity to treatment products, or pre-existing health conditions worsening. 

Interference with medical devices, such as pacemakers or implanted electronic devices. 

Increased frequency of urination, fatigue, or dehydration within 24-48 hours after treatment. 

Risk of pregnancy complications if applicable. 

I voluntarily assume full responsibility for any risks, whether known or unknown, associated with participating in these services. 

 

2. Health Disclosure and Contraindications 

I acknowledge that I have been informed of the contraindications for HydraWav3 services, including but not limited to: 

Pregnancy (including post-natal risks). 

Diabetes, heart conditions, blood clot disorders, or use of blood thinners. 

Skin conditions, open wounds, varicose veins, or recent surgeries (cosmetic or otherwise). 

Epilepsy, seizure disorders, or sensitivity to electromagnetic treatments. 

I confirm that I have disclosed all relevant medical conditions. If I have any medical concerns, I affirm that I have consulted with a qualified healthcare provider before participating in these services. If I am pregnant or believe I may be pregnant, I will either disclose this information or refrain from participation for the safety of myself and my child. 

 

3. No Medical Claims or Guarantees 

I acknowledge that HydraWav3 makes no guarantees regarding the effectiveness of its services. I understand that: 

These services are not medical treatments and do not cure or diagnose medical conditions. 

The service provider is not a licensed medical professional and does not provide medical advice. 

Results may vary based on individual health conditions and factors outside the control of HydraWav3. 

 

4. Waiver and Release of Liability 

To the fullest extent permitted by law, I hereby release, discharge, and hold harmless HydraWav3 LLC, its owners, employees, contractors, agents, officers, successors, and assigns from and against any and all liability, claims, demands, damages, actions, causes of action, costs, and expenses (including legal fees) arising out of or in any way related to my participation in HydraWav3 services, whether caused by negligence or otherwise. 

This waiver applies to all potential claims, including but not limited to: 

Personal injury, disability, or death resulting from participation. 

Medical complications, allergic reactions, or interference with medications. 

Temporary or permanent skin discoloration, burns, or tissue reactions. 

Emotional or psychological distress related to the service experience. 

I understand that by signing this agreement, I voluntarily waive my right to sue HydraWav3 LLC for any injury, damage, or loss resulting from participation in its services. 

 

5. Indemnification Clause 

I agree to indemnify, defend, and hold harmless HydraWav3 LLC from any and all claims, liabilities, costs, and expenses (including attorney’s fees) arising from: 

Any injury or damages I sustain as a result of these services. 

My failure to disclose relevant medical conditions. Any claims brought by third parties due to my actions or negligence while receiving services. 

 

6. Media Consent

I consent to HydraWav3 LLC using photographs, videos, or testimonials of my participation in services for marketing, promotional, or educational purposes. I understand that my identity will remain confidential unless explicitly authorized. 

 

7. Legal Considerations

Binding Agreement: This agreement is binding upon myself, my heirs, assigns, and legal representatives.

Severability: If any portion of this agreement is found to be legally unenforceable, the remaining provisions shall continue in full force and effect. 

Governing Law: This agreement shall be governed by and interpreted under the laws of the State of Arizona. 

 

8. Acknowledgment and Signature 

By signing below, I confirm that: 

✔ I have read and fully understand this liability waiver and release. 
✔ I acknowledge that I am voluntarily assuming all risks associated with HydraWav3 LLC services. 
✔ I understand that I am waiving my legal rights to hold HydraWav3 LLC liable for any injury or damages. 

I freely and voluntarily sign this agreement, intending to be legally bound by its terms.
